Terms of Service (TOS) and End User License Agreement (EULA)
These Terms of Service ("TOS") and End User License Agreement ("EULA") govern the access to and use of digital assets. By purchasing, downloading, or using any exclusive digital asset provided by Snowy Aura, you agree to be bound by these terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using SA Development's digital assets or services, you acknowledge that you have read, understood, and agree to be bound by these TOS and EULA. If you do not agree with any of these terms, you must not use our services or purchase our digital assets.
2. Definitions
"Digital Assets" refers to downloadable or streamable content including, but not limited to, images, files and other digital products sold or distributed by SA Development.
"User" refers to any individual or entity that accesses or uses the Discord and/or purchases or downloads Digital Assets from SA Development.
"License" refers to the permission granted to the User for the use of Digital Assets as defined in the EULA section.
3. Digital Asset License Grant
Upon purchasing a Digital Asset, SA Development grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to use the Digital Asset in accordance with the terms specified in this EULA.
4. Usage Rights
You may use the Digital Asset for personal, non-commercial purposes, including personal or private projects. Furthermore, you may use the Digital Assets in connection with modded multiplayer platforms for Grand Theft Auto V, including, but not limited to, FiveM, AltV, RageMP.
5. Restrictions
You shall not monetize, sublicense, resell, or redistribute the Digital Asset in any form.
You shall not modify the Digital Asset or create derivative works based on it, except if exclusive permission has been granted.
5.1 No Ownership Rights
You acknowledge that you do not acquire any ownership rights in the Digital Assets and that all intellectual property rights in the Digital Assets remain the exclusive property of SA Development* or its licensors.
6. Payments and Refunds
All prices for Digital Assets are listed in US$ (United States Dollar). Payments must be made in full before access to Digital Assets is granted.
Refund Policy: Due to the nature of digital products, all sales are final. No refunds or exchanges are permitted unless at the discretion of Snowy Aura.
7. Intellectual Property Rights
All Digital Assets and content in the Discord posted by Snowy Aura, including logos, designs, and images, are the intellectual property of SA Development or its licensors. These materials are protected by copyright, trademark, and other intellectual property laws.
You agree not to infringe on these rights or use the Digital Assets outside the scope of the license granted.
8. Termination
SA Development may suspend or terminate your access to its Digital Assets, and services at any time for any reason, including but not limited to violations of these TOS and EULA. Upon termination, you must immediately cease using and delete all copies of the Digital Assets.
9. Disclaimers and Limitation of Liability
Disclaimer of Warranties: The Digital Assets are provided “as is” without warranties of any kind, either express or implied, including but not limited to the fitness for a particular purpose, or non-infringement.
Limitation of Liability: In no event shall SA Development be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of profits, revenue, or data.
10. Indemnification
You agree to indemnify, defend, and hold harmless SA Development and its affiliates, from any claims, losses, damages, liabilities, and expenses arising from your use of the Digital Assets or violation of these TOS and EULA.
11. Modifications to the Terms
SA Development reserves the right to modify or update these TOS and EULA at any time. You will be notified of such changes through #announcements or via #changelog, and your continued use of the services after such changes indicates your acceptance of the updated terms.
